Rights :
👉 Rights are those rights which a person needs to live the life which he demands.
👉 Rights are those conditions of social life without which no man can develop himself.
Declaration of Rights:
👉 The list of rights provided and protected by the constitution is called 'Declaration of Rights'.
👉 It prevents the government from working against the rights of citizens.
👉 It ensures remedial action in case of violation.
👉 # In 1928, the 'Motilal Nehru Committee' had demanded a 'Declaration of Rights'.
Fundamental Rights :
👉 Such rights which are very necessary for the survival of a person and which are listed and protected in the constitution, they are called fundamental rights.
👉 These are so important that the constitution itself ensures that even the government cannot violate them.
👉 The constitution itself guarantees their safety.
General Rights and Fundamental Rights :
👉 Where ordinary laws are used to protect and enforce common legal rights, the Constitution itself guarantees and protects fundamental rights.
👉 General rights can be changed by Parliament by making laws, but to change the fundamental rights, the constitution has to be amended.
👉 No part of the government can do any work against the fundamental rights.
👉 The judiciary has the power and responsibility to prevent the violation of fundamental rights by the actions of the government.
👉 If any act or decision of the legislature or executive violates the fundamental rights, then the judiciary can declare it illegal.
